Police brutality and misconducts is a criminal act
The role of being a police officer in a community viewpoint is to answer calls of emergencies from civilians, monitoring criminal activities, and arresting individuals who are suspects of a crime. Not to harm or kill civilians that have not committed any crime or nor have been given warnings of shooting them unless it was self-defense for themselves or for the safety of the public. Police brutality results in the lack of trust towards policemen, it is their task to protect citizens, not harm them. Brutality disgraces professional honor.
A police misconducts is refer to the "Improper or illegal behavior engaged in by a police officer while attempting to administer justice" which involves the example of police brutality. According to the Department of Justice , "Federal laws that are address police misconduct include both criminal and civil statutes. These laws cover the actions of State, country, and local officers, including those who work in prisons and jails." Many other types of misconduct are abuse of authority and false arrest. Most police misconducts events are now often seen on YouTube, since in the past many misconduct events were assumed to be false but now there are many videos to show proof and expose police misconducts. An example of this can be of an recent event such as the Stephon Clark shooting.
Stephon Clark was shot by police officers 20 times in his grandmother's backyard because the officers mistook his phone for a gun. He received no warning as the two officers shot him down. It is stated in the Fourth amendment "protects people from unreasonable search and seizures by the government." Police officers are able to use deadly force only if they had a situation cause that they believed that they believed that the suspect will harm the officer or any bystander. Although police officers cannot get fired for failure of violate someone's constitutional rights, but they can be fired when there was no need to use deadly force and lack of proper justification. Officers may use deadly forces if it is necessary to suppress the arrestee.
Deadly force is an amount of force that can cause major injuries to someone's body or in other cases their death. Citizens are able to deadly forces in matters of self-defense, but for police officers they can uses deadly forces in a different circumstances. In police terms, deadly force can also be reference as to shoot or kill for only if the offender resist arrest. Another reasonable cause for police to use deadly force is when they are placed in a split-moment situation. Granted it is not always the excuse of why they shoot the offender, but on how the situation could have ended one way or another. According to the National Institute of Justice, "Law enforcement officers should use only the amount of force necessary to mitigate an incident, make arrest, or protect themselves or others from harm." Police officers have legal standards to protect themselves and bystanders, yet does not give them standards for killing innocent civilians.
The point is not that police officers should not carry guns with them on their line of duty, but to use them for the safety of the community. Police brutality is a social issue because many people are being harmed by police officers that abuse their power and are causing innocent lives to be placed into situations they should not be in. This is not a limited cause that can go away, since not many officers get charged or kicked off the force for killing innocent lives. People have the freedom and right to express their rights and police brutality violates human rights.

Social media makes it easier to verify occurrences of all crimes, including police brutality. That is a good point. Another good point is the noting of how difficult it is for police to evaluate what they should do in potentially dangerous situations.
ReplyDeletePolice brutalities makes the public wonder about their own safety. If the police is not doing their job in protecting citizens, that is a serious issue not only for the public, but for the police department to handle. This is a shame for the police because we are suppose to rely on them and what they do as their duty to protect citizens, not to be scared of them. There are many police misconducts and it is still increasing in the U.S.. The Supreme Court is also involved and actually letting these cops pass on what they did. The police could always figure a different strategy out, instead of just killing them immediately.
ReplyDeleteAlthough Stephon Clark’s death is very saddening, I like how you used a recent example of police brutality as evidence. Now, it seems like most people overlook the death of not just an African American, but the death of any person due to police brutality because of how often it happens. Most people don’t know that police brutality includes the smaller things such as false arrest, racial profiling, or even harassment, and it makes the public scared for their own safety. I strongly believe officers like the one who arrested Freddie Grey, Stephon Clark, or even Oscar Grant are the ones who take advantage of the privileges of their job.
ReplyDeleteI'm with you that police brutality disgraces the uniform. But not all instances of it are with men (so use, perhaps, "police officer" here?). I wonder in paragraph 2, is that quote correct? It's a bit hard to follow and I'm not sure the Department of Justice would make a public statement that way.
ReplyDeleteYou say here that police shouldn't carry weapons. Are you modeling that action after police in England who usually are not armed? What are the statistics of police brutality there and in other places where police officers don't carry? I think that would be quite interesting to see...
